Toward Islamic Reform
The latest academic legal research of Dr. Mark A. Gabriel presents a model to reform Islamic Criminal Law to reconcile it with international human rights
Dr. Gabriel has found a way to counter the radical Islamic interpretations with fully Islamic arguments: arguments that are based on Shariah itself and on the ancient Islamic writings.
Islamic Criminal Law, including the death penalty for whom they consider ‘enemies of Islam’ is claimeded to be divine and infallible.
What many people in the West are not aware of is the fact that Islamic Criminal Law with its problematic rulings, including the death penalty for apostates and for whom they consider ‘enemies of Islam’ is not just an invention of some extremists, but it is practiced in several Muslim countries.
What makes it even more challenging is the widespread understanding that Islamic law is divine and infallible and that it can therefore not even be questioned.
Radical Islamic ideology is one of the predominant problems in our world today. It is responsible for countless terrorist attacks in the West and all over the globe, and also for countless human rights violations in many Muslim countries.
Attempts to fight radical Islam from outside by using physical weapons are doomed to failure. The war on terrorism declared by America after 9/11 has killed thousands of people on both sides, but it did not solve the problem with radical Islam. Quite at the contrary, the problem is today worse than it was in 2001. Since the problem is with an ideology and a law based on that ideology, it can be changed only from inside. It has to be tackled from its roots.
The good news is that Dr. Gabriel has found a way to counter the radical Islamic interpretations with fully Islamic arguments: arguments that are based on Shariah itself and on the ancient Islamic writings.
Thanks to his profound scholarly knowledge of Islamic Law and the ancient Arabic writings, Dr. Gabriel was able to examine the most problematic rulings of Islamic criminal law in the light of the Qur'an and the correct Sunnah. He found out that the claim that Islamic law is divine and infallible results from a failure to distinguish between Shariah and Islamic Law.
During three years of extensive research on the topic Dr. Gabriel was able to identify those rulings of Islamic law that contradict Shariah. He was able to lay out that reforming Islamic law is possible and islamically legitimate and he presents a model, how this can be done.
The result of Dr. Gabriels study has been examined by several Islamic scholars and has been praised as overwhelmingly profound, convincing and well researched. The study has been approved as a legal scientific PhD dissertation by one of the most prestigious law schools worldwide, the Faculty of Law of the University of Cape Town.
Dr. Gabriel demonstrates that Reforming Islamic Law is possible and islamically legitimate
The study is an eye-opening and a powerful tool for everyone
All the sincere, peace loving Muslims will be encouraged and equipped through this research to come out of their corner of silence and to boldly promote their peaceful attitude. In this study they will find all the necessary facts and arguments to defend their position against radical Islamic interpretations. Furthermore, moderate Muslim politicians, governments, judges and lawyers can find in this study Islamic scholarly guidelines to promote laws and judgements that are in compliance with international human rights laws, while still being fully loyal to Shariah.
Western countries that offer Islamic studies as part of their educational system can use the study as a guideline in developing their curriculum and monitoring what is being taught. Furthermore, the study can be of great help to Western institutions that work in the area of prevention or de-radicalization.
Hence, the study can make a real difference in our world today.
